49cc Mini pocket nike LAWS?

I just purchased a X1 2nd Generation mini pocket bike for my 8 year old son.

He loves the thing to death, and he rides it very well.

I make him obey rules and even let him buzz up and down the road. We live on a side road, 300 miles North of Detroit.

Since it is under the 50cc mark, it is not registrable, so it is classified as a minibike.

Not road legal, can we get in trouble for riding it on the side of the road?????
You can ride ATV on the side of the roads legally here, so I would think he would be okay too

Any ideas??
